India’s National Environment Policy (NEP), 2006 was the country’s first attempt to bring scattered environmental laws, sectoral policies and judicial interpretations under one strategic umbrella. While its objectives lay out the vision, the real engine of the policy lies in its actions and strategies – the concrete steps that translate principles like “polluter pays” and “precautionary action” into rules, projects and partnerships. These strategic actions cover everything from cleaning up the Environmental Impact Assessment (EIA) process to negotiating climate technology transfers, and they continue to shape programmes like the National Clean Air Programme and the Swachh Bharat Mission today.

Why strategic actions matter in NEP 2006

Before 2006, environmental governance was governed largely by sector-specific instruments – the Forest Policy of 1988, the Water Policy of 2002, the pollution abatement statement of 1992, and others. The NEP openly acknowledged that this fragmented approach had created overlaps, gaps and weak enforcement. Strategic actions were therefore designed to do three things at once: fix process bottlenecks, conserve resources, and build the institutional muscle needed for long-term sustainability. As the policy text itself notes, these actions are meant to be operationalised through Panchayats, Urban Local Bodies and multi-stakeholder partnerships, not just central ministries.

Regulatory reforms: fixing the rules of the game

The policy treats regulatory reform as the foundation on which every other strategy rests. Two streams run in parallel – process-related reforms and substantive reforms.

Process reforms target delays, opacity and over-centralisation in environmental clearance. The aim is to decentralise decision-making to State and Union Territory levels while building the human and institutional capacity to handle that responsibility. Specific actions include assessing the chemical-accident potential of projects during the clearance stage, examining the productivity of land proposed for diversion, and clustering industries so that shared environmental infrastructure becomes viable. The policy also pushes for post-monitoring of approved projects and mandatory restoration plans for mine closures.

India had historically leaned heavily on criminal sanctions for environmental violations – a route that has often proved slow and difficult to enforce. NEP 2006 calls for a judicious mix of civil and criminal liability, including fault-based and strict liability regimes. This shift opened the door to specialised institutions like the National Green Tribunal, established in 2010, which now handles environmental disputes with technical expertise. The policy also instructs authorities to review and update existing statutes, harmonise overlapping regulations, and identify emerging areas – such as biosafety for living modified organisms – where new legislation is required.

Resource conservation: protecting India’s natural capital

The second cluster of strategic actions focuses on conserving the environmental resources that underpin livelihoods and economic growth. The policy treats land, water, forests, biodiversity and wetlands as a connected system rather than isolated sectors.

Sustainable land use and combating degradation

NEP 2006 promotes science-based and traditional land-use practices through research, pilot demonstrations and farmer training. It calls for reclamation of wastelands and degraded forest land through partnerships involving land-owning agencies, local communities and investors. A specific target was to raise forest and tree cover from 23 percent of the country’s land area to 33 percent by 2012, supported by afforestation on revenue and private lands. While that target was not fully met, the underlying strategy of multi-stakeholder afforestation continues to inform programmes like the Green India Mission.

Water, wetlands and freshwater systems

The policy promotes integrated watershed management, treating soil conservation, groundwater recharge and surface water management as one continuum. For wetlands, it recommends a legally enforceable regulatory mechanism to prevent degradation and explicitly factor wetland impacts into environmental appraisal of large projects. Sustainable tourism strategies developed with local communities are encouraged for ecologically significant wetlands.

Biodiversity and environmentally sensitive zones

Biodiversity strategies emphasise participatory forest management through Joint Forest Management committees, expansion of the protected area network, and conservation efforts beyond protected boundaries into production landscapes. Crucially, the policy calls for identifying and giving legal status to Environmentally Sensitive Zones – areas with ecological entities of “incomparable value” needing special protection. The implementation of the Panchayats (Extension to Scheduled Areas) Act, 1996 was also flagged as a strategic step to secure tribal livelihoods and reduce conflict with forest departments.

Environmental standards and clean technologies

Setting credible standards and promoting clean technologies is where regulation meets innovation in NEP 2006. The policy moves beyond uniform national norms to a more risk-based and locality-sensitive approach.

Smart standard-setting

Environmental standards under NEP 2006 are to be set after weighing risks to human health, risks to ecosystems, technical feasibility, costs of compliance, and strategic considerations. This means a coal-fired power plant in a densely populated airshed may face stricter emission norms than the same plant in a less sensitive area. The Central Pollution Control Board revises ambient air quality and effluent standards in this spirit, and the National Ambient Air Quality Standards revised in 2009 reflect this layered approach.

Promoting clean and low-carbon technology

The policy calls for an integrated approach to energy conservation and renewable energy – improving conversion, transmission, distribution and end-use efficiency together with research and dissemination of renewable technologies. Hydropower, solar, wind, and biomass are all flagged for accelerated deployment. Small-scale industries, which account for a significant share of pollution but cannot easily afford end-of-pipe controls, receive special attention through assistance for adopting clean production techniques.

Market-based instruments

NEP 2006 explicitly promotes the polluter pays principle, asking that the cost of pollution prevention and damage be internalised by those responsible. Incentive-based instruments – emissions trading pilots, tax differentials for cleaner fuels, fee structures based on pollution load – are encouraged alongside command-and-control regulation. The 2010 introduction of a clean energy cess on coal and the later perform-achieve-trade scheme for energy-intensive industries reflect this policy direction.

Capacity building: people and institutions behind the policy

A common reason environmental laws underperform is weak institutional capacity at the level where rules actually bite – districts, panchayats, and municipal corporations. NEP 2006 dedicates a strategic theme to closing this gap.

Strengthening environmental institutions

The policy seeks to upgrade State Pollution Control Boards, environment departments and regulatory authorities with better staffing, training and access to modern monitoring equipment. It also recommends establishing dedicated environmental data systems and supporting research institutions to generate locally relevant scientific evidence. The Research in Environment scheme of the Ministry of Environment, Forest and Climate Change carries forward this mandate by funding ecological research aligned with policy priorities.

Devolution to Panchayats and Urban Local Bodies

Effective environmental management of village commons, urban green spaces and small water bodies is impossible without local bodies. The policy urges that Panchayats and Urban Local Bodies be empowered with functions, functionaries and funds for environmental tasks, supported by capacity-building programmes on waste management, water conservation and biodiversity registers.

Public participation and environmental education

NEP 2006 builds in robust public participation by emphasising access to environmental information, public hearings during environmental clearance, and the involvement of community-based organisations and NGOs. Environmental education – from school curricula to professional training – is treated as a long-term capacity strategy rather than an add-on.

International cooperation: India in a globally connected ecology

The policy recognises that several of India’s pressing environmental challenges – climate change, transboundary air pollution, biodiversity loss, ozone-layer depletion – cannot be solved within national borders alone.

Multilateral engagement

NEP 2006 affirms India’s commitments under major multilateral agreements such as the United Nations Framework Convention on Climate Change, the Convention on Biological Diversity, the Montreal Protocol, and the Stockholm Convention on Persistent Organic Pollutants. The policy frames India’s stance on common but differentiated responsibilities and equity in global negotiations, a position that has shaped India’s contributions to the Paris Agreement and subsequent updated Nationally Determined Contributions.

Technology transfer and finance

Strategic actions on international cooperation focus on facilitating transfer of environmentally sound technologies on favourable terms, mobilising international finance for environmental projects, and encouraging South-South cooperation among developing countries facing similar ecological pressures. Initiatives like the International Solar Alliance, co-founded by India in 2015, embody this approach by pooling demand and finance across solar-rich developing nations.

Transboundary issues and shared resources

The policy commits to working with neighbours on shared rivers, regional air pollution and migratory species. Cooperation under the South Asian Association for Regional Cooperation on disaster management and biodiversity corridors reflects this strategic orientation.

Where the strategy stands today

Nearly two decades after its adoption, the strategic actions of NEP 2006 remain the silent architecture behind many contemporary programmes – the National Clean Air Programme, the Jal Jeevan Mission, the Green Credit Programme, and India’s net-zero by 2070 pledge all draw on its principles. The gaps, too, are visible: forest cover targets remain unmet, urban air quality in many cities still exceeds national standards, and decentralised capacity remains uneven. The policy was never meant to be a one-time solution but a living framework, and that is exactly how it continues to operate.
